THESE TERMS CONTAIN A BINDING ARBITRATION AGREEMENT THAT AFFECTS YOUR LEGAL RIGHTS AND LIMITS YOUR ABILITY TO BRING CLAIMS IN COURT, PARTICIPATE IN A CLASS ACTION, OR HAVE DISPUTES DECIDED BY A JUDGE OR JURY. - Product Information and Specifications
4.1 Made-to-Order & In-Stock Items. Unless otherwise indicated, all jewelry pieces are made-to-order. Limited quantities of select items may be listed as in stock.
4.2 Lab Diamond Specifications. All lab diamonds used in our pieces are graded F/G color, VS1 clarity and above and may include IGI certificates for diamonds 1 carat and larger.
4.3 Reasonable Variations. Because each piece is individually crafted, slight variations in size, weight, polish, and appearance may occur. These normal variations are not defects.
4.4 No Warranty. SAPPHAE DOES NOT OFFER EXPRESS WARRANTIES ON PRODUCTS. ALL ITEMS ARE SOLD “AS-IS” WITH NO WARRANTIES BEYOND WHAT IS REQUIRED BY LAW.
SAPPHAE HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE. THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
5. Ordering, Payments & Order Acceptance
5.1 Payment Methods. We accept all major credit cards for online purchases.
5.2 Account Creation. Customers may check out as a guest or create an account for faster checkout and order tracking.
5.3 Sales Tax. Sales tax is charged in New Jersey only. No tax is collected for other states at this time.
6. Shipping & Delivery
6.1 Shipping Carrier. Orders are shipped via USPS.
6.2 Shipping Rates. Shipping is charged at a flat rate displayed at checkout.
6.3 Signature Confirmation. All jewelry shipments require signature confirmation, regardless of value.
6.4 International Shipping. We do not offer international shipping at this time.
6.5 Processing Times. Made-to-order items typically ship within 6–8 weeks. In-stock items typically ship within 3–4 business days.
7. Returns, Exchanges & Refunds
7.1 Return Eligibility. Returns are accepted only for non–made-to-order items within a 2-week return window from the delivery date.
7.2 Non-Returnable Items. The following items cannot be returned: made-to-order jewelry, custom designs, engraved items, worn items, or items showing signs of use.
7.3 Condition Requirements. Returned items must be unworn, free of scratches or damage, and returned with all original packaging and certificates.
7.4 Restocking Fees. Sapphae does not charge restocking fees.
7.5 Return Shipping Costs. Sapphae covers the cost of return shipping for eligible items.
7.6 Exchanges & Store Credit. Exchanges and store credit are offered only for in-stock items.
7.7 Damaged or Defective Items. If an item arrives to Sapphae damaged from the shipping carrier, Sapphae will file the carrier complaint on your behalf.
7.8 Refund Timeline. Refunds are processed within 7–10 business days after the returned item is received and inspected.
8. Lost, Stolen or Delivered Packages
8.1 Insurance. All packages are shipped insured.
8.2 Delivery Confirmation. Once USPS marks a package as delivered, responsibility for the package transfers to the customer.
8.3 Carrier Claims. Customers must file any necessary claims directly with USPS before Sapphae can provide further assistance.
9. Custom Orders
9.1 Payment. Custom orders require full payment at the time of purchase.
9.2 Design Proofs. Customers receive sketches or digital mockups for approval before production begins.
9.3 Approval Required. Production will not begin until written approval is received.

10.1 Free Resizing. We offer one free resizing per ring.
10.2 Resizing Timeline. Resizing requires approximately 2–4 weeks.
10.3 Shipping Costs. Sapphae covers shipping for resizing services.
11. Intellectual Property
All jewelry designs, images, descriptions, and website content are protected intellectual property. Customers may not copy, reproduce, distribute, or create derivative works using Sapphae designs or media.
12. Limitation of Liability
SAPPHAE IS NOT LIABLE FOR NORMAL WEAR AND TEAR, CUSTOMER MISHANDLING, INCORRECT SIZING PROVIDED BY THE CUSTOMER, OR DELAYS CAUSED BY SHIPPING CARRIERS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAPPHAE’S LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE ITEM.
IN NO EVENT WILL SAPPHAE, EMPLOYEES, AGENTS OR OFFICERS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE THE WEBSITE, ANY CONTENT ON THE WEBSITE OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE WEBSITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
13. Privacy & Data
13.1 Marketing Communications. We collect email addresses for marketing through Shopify-integrated apps and our email platform.
13.2 Third-Party Sharing. We do not sell personal data but may share information with third-party providers strictly for order fulfillment. See our Privacy Policy for more details.
14. Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
BY PURCHASING FROM SAPPHAE OR USING OUR WEBSITE, YOU ARE AGREEING TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION AND WAIVING CERTAIN RIGHTS, INCLUDING THE RIGHT TO GO TO COURT.
14.1 Agreement to Arbitrate
You and Sapphae agree that any dispute, claim, or controversy arising out of or relating to:
- your purchase of our products,
- your use of our website,
- these Terms & Conditions,
will be resolved exclusively through final and binding arbitration, and not in a court of law.
14.2 WAIVER OF RIGHT TO SUE IN COURT & JURY TRIAL
By agreeing to arbitration, you are knowingly and voluntarily giving up your right to:
- file a lawsuit in court,
- have a judge decide your case,
- a jury trial, and
- participate in class actions or class-wide proceedings.
ARBITRATION IS CONDUCTED BY A NEUTRAL ARBITRATOR INSTEAD OF A JUDGE OR JURY.
14.3 Waiver of Class Actions and Class Arbitration
You agree that disputes will be resolved on an individual basis only.
You may not participate in:
- class actions,
- class arbitrations,
- private attorney-general actions, or
- consolidated claims.
The arbitrator has no authority to hear grouped or representative claims.
14.4 Small Claims Option
You may bring an eligible claim in small claims court, instead of arbitration, if your claim is within the court’s monetary limits and filed individually.
14.5 Arbitration Rules & Procedures
Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
The arbitrator, not any court, has authority to resolve disputes related to:
- the interpretation of this arbitration clause,
- enforceability,
- the scope of issues subject to arbitration.
14.6 Governing Law
This Agreement is governed by the laws of the State of New Jersey, without regard to conflict-of-law rules.

15. Waiver
Any waiver by either you or Sapphae of any provision or condition of the Terms & Conditions shall not be construed or deemed to be a waiver of any other provision or condition of the Terms & Conditions, nor a waiver of a subsequent breach of the same provision or condition, unless such is expressed in writing and signed by the party to be bound.
16. Severability
If any portion of these Terms & Conditions is unlawful, void or unenforceable, the remaining provisions will remain in place.
17. Entire Agreement
The Terms & Conditions, Privacy Policy and all Additional Terms, constitute the entire agreement between you and Sapphae with respect to the Website and supersede all prior and contemporaneous negotiations, agreements, proposals and understandings both written and oral, with respect to the Website.
